ECJ rules on milk classification case
In this Dutch case involving the classification of a product obtained from curdled milk, the ECJ has ruled that heading 0406 of the Combined Nomenclature should be interpreted in such a way that it can accommodate the classification of a product, as referred to in this case, which is obtained from curdled milk. Of potential wider interest, however, is the Court's comment that the intended use of a product can be a factor in deciding its customs classification (Op - en Overslagbedrijf Van der Vaart: C-402/06).
